The court case will likely be used as the framework of the next election. If Raila and his coalition wins, it is easy to imagine that they will not accept another election with the same election management body, therefore creating a protracted governance crisis until they are assured of a place in government. If they lose, that will almost certainly the knock out punch out of the political ring for Raila. However, the conditions of such a loss will be crucial. If Supreme Court kicks out the case without justifying/defending current IEBC’s tally, then Raila and his people will use that to claim Ruto’s government is illegitimate. I think for the sake of Kenya’s institutional strength, IEBC should request the Supreme court to clearly say whether the process and final results are legit. Anything else will undermine this and future elections regardless of who wins.
